Belgrade - The Commissioner for information of public significance, Rodoljub Sabic, acclaimed yesterday the announcements made by the competent people from the government of Serbia, that the information about the materialization of the projects from the national investment plan would be significantly more accessible in the future to the widest public, including also their presentation on the Internet. Sabic estimated that the announced measures could give very useful results, and that it was thus very important to materialize them as soon as possible.

Not even two weeks after announcement concerning disclosure of the Concession Contract for Horgos-Pozega highway to public, this has not been done. Namely, as Government quoted, publicity of the one of biggest investments in the country is presently unavailable due to Article 24, stating that the Contract may not be published. That provision provides the space for Concessionaires to sue the Government if the Contract is published.

RODOLjUB SABIC'S VIEW OF THE CONCESSION HORGOS-POZEGA

The Public Information Commissioner Rodoljub Sabic stated yesterday that he expects Serbian Government to make the Concession Contract for Horgos-Pozega highway publicly available, because they are liable to do so according to the Constitution and Law on Free Access to Information of Public Importance. Sabic specified that the Serbian Constitution in its Article 51 guarantees the right of access to information owned by the government, and the Law on Free Access to Information determines and elaborates this right. "All our authorities shall be liable to fully harmonize their behavior, including arrangements with foreign partners, with obligations stemming from our Constitution and the Law.

What do you think of the possibility that it occurs to somebody to set the rule, thus breaching the law on the traffic, that instead of the right highway laine, people must drive in the left one in a highway of ours, unless the concessionary of the highway allows the opposite?  Naturally, many people will say that the question is futile - all around the world it is known and is irrevocable, that in no way can commercial contracts contradict the state legislation. True, but IS it like that here, in our country, as well?

The public still does not have insight into provisions from the Contract on Horgos-Pozega highway. The Ministry of Capital Investments has initiated procedure for revoking Information Commissioner's Decision to make public parts of the Contract.
