The Commissioner for Information of Public Importance and Personal Data Protection Mr. Rodoljub Sabic believes that the Law on Consumer Protection, which came into force on the 1^st of January of this year, besides the new conditions and measures specific to consumer protection, also introduced important instruments of privacy and personal data protection into our legal system by explicitly defining “unsolicited and invasive business practices”.

The Commissioner invited all legal persons and entrepreneurs to respect the privacy of the citizens, and to bear in mind that, for “unsolicited and invasive business practices”, the Law introduces relatively harsh monetary penalties, while he also invited the citizens to utilize their rights, and, in cases of infringement, seek protection and hold the violators accountable for their violations.

In this regard, the Commissioner also stated the following:

The Commissioner for Information of Public Importance and Personal Data Protection Mr. Rodoljub Sabic welcomed the adoption of the Decision of the Government of the Republic of Serbia, which states that all state administration bodies have to provide the data to the National Information Technology and Internet Agency as to where, meaning on which website, their Information Booklet has been uploaded, while the Agency is obliged to create a separate web page with the aforementioned website URLs on the E-Governance portal within 15 days from the day of the Decision.

Besides stating that this Decision of the Government, bearing in mind that the Government needs to ensure its full implementation, could be a considerable contribution to the fulfillment of the right of the public to information, the Commissioner Mr. Rodoljub Sabic also said the following:

The Commissioner for Information of public importance and the protection of personal data Rodoljub Sabic,  considers there to be a very unfair way in which the Minister of Finance Diana Dragutinovic, when presenting the draft budget for 2011. presented a position group of independent national institutions. Stating that such an act of the Minister is not in the interest of objective information of the public, nor in the interest of fair relations of the government ministries and independent bodies, the Commissioner Rodoljub Sabic said the following:

The commissioner for Information of public importance and the protection of personal data, Rodoljub Sabic, regarding the submission of the Bill for the opening of the files of secret service, estimates that the very  beginning of  the process of opening the files of security services in Serbia, deserves full support.

However, the Commissioner warns that it is necessary prerequisite to the adoption of the Law with equitable, qualitative and, most importantly, enforceable solution to the previously detailed look at the real dimensions of this task, and to define and provide the means necessary for its implementation. Without this, the law couldn’t serve a real purpose, and also could become a new source of threat to constitutionally guaranteed rights and the law.

In this regard, the Commissioner Rodoljub Sabic said the following:
