The Commissioner for Information of Public Importance and Personal Data Protection is conducting a supervision procedure over the implementation of the Law on Personal Data Protection (LPDP) by the Privatization Agency.

The supervision procedure was launched several days ago and it would last for some time; however it is now evident that the results of the procedure will be the most drastic confirmation of the incomprehensible, irresponsible attitude of the state towards the right to personal data protection.

A vast amount of personal data (name, surname, Personal ID Number and some other data) of almost all adult citizens of the Republic of Serbia is exposed to the risk of unauthorized processing and abuse.

Following the surveillance procedure, the Commissioner shall, as usual, inform the public about all relevant facts, institute misdemeanor proceedings against the responsible persons and require the prosecutors' offices and MoI to institute (ex officio) proceedings so as to establish criminal liability.

In this regard the Commissioner, Rodoljub Sabic, has stated the following:

On occasion of 10 December, the International Human Rights Day, the Commissioner for Information of Public Importance and Personal Data Protection has issued a warning that the fact that significant segments of human rights are not regulated in a proper manner, always involves the risk of threats to and violations of those rights. In this regard he has recalled that the Government of the Republic of Serbia launched an initiative for passing the Law on Security Checks more than two years ago.

In this regard the Commissioner, Rodoljub Sabic, has stated the following:

The Commissioner for Information of Public Importance and Personal Data Protection has been addressed by a large number of health care institutions seeking his opinion on the situations in which they are faced with the requests of public prosecutor's offices, directly or via the police, for forwarding the documentation on the health status of their patients.

The Commissioner estimates that this is yet another situation in a series of situations which confirms a disturbing inconsistency of our normative system, particularly in the field of personal data protection. In this regard he has forwarded letters to the Minister of Health and the Republican Public Prosecutor highlighting the necessity of introducing appropriate legislative solutions and of the harmonization of their handling by the public prosecutor's offices.

In this regard the Commissioner, Rodoljub Sabic, has stated the following:

The Commissioner for Information of Public Importance and Personal Data Protection has forwarded a Warning to the Ministry of Interior on occasion of the enforcement of the Law on Personal Data Protection (LPDP) due to its failure to take the required technical, HR and organizational measures to safeguard the medical data on the health status of police officers, which is considered particularly sensitive personal data.
