Our Constitution guarantees freedom of opinion and expression, and based on it media freedom (Articles 46 and 50) in the way which is in good correspondence with Article 10 of the European Human Rights Convention, which is in this field fundamental European legal document. Provisions from paragraph 1 Article 10 of the Convention guarantee anyone the right to freedom of expression, including the freedom of opinion, freedom to receive and transfer information and ideas, without intervention of the public authority and regardless of the limits. Paragraph 2 envisages that exercising these freedoms can be subject only to such formalities, limits or sanctions which are „provided in the law and which are necessary in a democratic society in the interest of national security, territorial integrity or public safety, prevention of disorder or crime, protection of health and morale, renown or the rights of the others, prevention of spreading confidential information or in the interest of preserving authority and impartiality of the judiciary."Source: "Blic"
Journalist P.Lj. has publicly accused a manager of one big company that he has ruined the company, that it has huge outstanding liabilities, including those towards the state, and thus he has become a „subject" of three criminal procedures because of "libel and insult". In order to defend himself, he asked from Tax Administration information on that debt. He has been declined, and just after the decision of the Commissioner for Information he received those information confirming the debt exceeding 600 million dinars. During execution of the Commissioner's order, the Administration has however felt asked to also „show him certain things", to warn him (probably under impression that the Commissioner does not know that), that according to the Law on Tax Procedure data from tax procedure are official secret, and due to unauthorized disclosure of the official secret the taxpayer whose rights have been infringed acquires the right to require damages in front of the court in charge.

The biggest attention in the Proposal of Amendments of the Law on Information deserve provisions that due to decrease of equity or blockade of the company account envisage obligation of the publisher to stop issuing his paper, under threat of fine up to even 20 million dinars. I think that these and all the other provisions envisaging limit in issuing newspapers must be envisaged in the context of Article 10 of European Human Rights Convention and the European Human Rights Court. The Convention provisions, which guarantee the freedom of expression and the practice of the Strasbourg Court have already defined the freedom of expression, because they include certain obligations and responsibilities. These can be limited, but only under assumption of cumulative fulfillment of all three conditions. As first, that the sanctions, conditions, measures and the like have been envisaged by the law.

Commissioner for Information Rodoljub Sabic warns that the Proposal of the Law on Informing is contravening European Human Rights Convention!
Proposal of the Law on Public Informing is contrary to the European Human Rights Convention, where Article 10 clearly prescribes that the freedom of informing can not be limited by anything, claims the Commissioner for Information of Public Importance, Rodoljub Sabic.
According to Sabic's words, if such Law Proposal would be adopted in the Assembly, each media suffering fines in millions of dinars could appeal to the European Human Rights Court in Strasbourg, and receive damages from the State of Serbia!
Sabic warns that the Court in Strasbourg, formed exactly on the basis of the Convention, would surely pass judgments that would credit the „sentenced media".
