Which information are inaccessible to the public

 

The Commissioner wrote a letter in which he complains to the Prime Minister. Inglorious leader the Ministry of Finance – in 20 cases it failed to adhere to the binding decision of the Commissioner

 

The Government of Serbia, despite the warrant issued by Rodoljub Sabic, the Commissioner for Information of Public Importance, is still hiding the information about the five biggest investments in Serbia. The Government also keeps secret the information as to who the biggest state debtors are, in what manner „Duvanska industrija Nis“ was sold, but also data on the criminal proceedings related to the death of the journalist Dada Vujasinovic.

OBSOLESCENCE AND INJUSTICE

The news of offence charges that the State Auditor Institution filed against a group of former and current ministers has been, during the past few days, with a good reason, attracting a lot of attention. However, for a larger share of the public, the ‘parallel’ news was disappointing – there is a possibility that a great number of reports, if not all, would have no effect, as they would become obsolete. Disappointing, more so because this possibility is very probable. Not even statements of certain ministers (e.g.: … there is no way that the charges filed by the State Auditor Institution would be dropped due to obsolescence. I insist on finding out the truth. Now it will appear as if someone is trying to hide something…) can change much. It is absolutely irrelevant whether these statements are an expression of a sincere belief in one’s own innocence or a routine political demagogy. Simply, obsolescence is a legal entity of a mandatory, imperative character, the state institutions are obliged to pay attention to obsolescence ex officio (according to their scope of work, officially). When a case becomes obsolete in terms of passage of time, the offender cannot be prosecuted, regardless of whether he might be ready to undergo the proceedings.

Memorandum of Cooperation in the fight against corruption signed

Belgrade

The Commissioner for Information of Public Importance and Personal Data Protection, Rodoljub Sabic, and the representatives of the Public Procurement Directorate and the State Auditor Institution signed a Memorandum of Cooperation yesterday with an aim of improving joint activities in the fight against corruption. The President of the State Auditor Institution Council Radoslav Sretenovic emphasized that the main goal of this project is establishing responsibility and transparency, in order to strengthen the control and supervisory mechanisms of public fund spending. “Taking into consideration the available personnel capacities, the financial audit of the final Serbian budget balance for 2009 will be a priority, as well as the use of public funds by the National Bank of Serbia”, said Sretenovic. An initiative related to the obsolescence of offences has been put forward, he said, since the audit can only start once the final draft of the Serbian budget balance is submitted, around June 16, which would mean that all the offences that have been committed before the same date last year would become obsolete.

Šabić asks for the protection of phone call confidentiality

Rodoljub Šabić, the Commissioner for Information of Public Importance and Personal Data Protection, believes that the forthcoming law on electronic communications has to regulate the question of electronic communication privacy limitations, even though the cabinet of the Minister of Telecommunications claims that the law will not encompass such measures.

Secret service has been left too wide space for possible manipulation.

According to the Law on Security Intelligence Agency, collection of data on performed telephone communication, without insight into its contents shall not be deemed as infringing privacy of citizens, and therefore it necessitates only the Agency Manager’s decision.
