WHAT IS THE PURPOSE OF ARTICLE 146 OF CRIMINAL CODE?

PERSONAL STANCE

Can you imagine going to sleep with one ethnicity and waking up with another? Although putting such a “foolish” question as the opening line of a text dealing with a provision of the Criminal Code may seem as a digression, actually it is not. Such situation is not very likely; in fact it is not possible at all, is it? Of course, this is not because there are any issues with the freedom of each individual to change their awareness of their own ethnic affiliation. They, quite naturally, have the freedom to do so. Opinions on this issue evolved a long time ago and range from ultra-conservative ones, which view ethnicity as objectively determined, given and constant, to modern ones, which view ethnicity primarily as a matter of subjective feeling. But what is undisputable is that the awareness of one’s ethnic affiliation is formed by an individual on his or her own and that this awareness cannot be changed at the drop of a hat.

Commissioner for Information responds to accusations from the Ministry of Human and Minority Rights

“The State Secretary at the Ministry of Human and Minority Rights, Ms Aniko Muskinja-Heinrich, made a number of incompetent and unreasoned allegations and blatant fabrications in an interview published by the “Dnevnik” daily on 2 April”, claims the Secretary General of the Office of Commissioner for Information of Public Importance, Mr. Marinko Radic, in a communication sent to our newspaper.

ELEMENTARY (IN) DECENCY

Under our law, the protection of right to free access to information is achieved in two ways. In case of almost all public bodies it is achieved by lodging a complaint with the Commissioner for Information. The National Assembly, President of the Republic, Government,  Republic Public Prosecutor, Supreme Court, Supreme Court of Appeal and Constitutional Court are exemptions against which a complaint with the Commissioner cannot be lodged, however, administrative proceedings can be instigated instead by filing a lawsuit.

The Commissioner for Information of Public Importance and Personal Data Protection Rodoljub Sabic submitted to the National Assembly a work report for the previous year which shows an increase in the interest among the general public for the fulfillment of their rights, but the report also indicates that he is dealing with some old issues again.

Broken telephones

The information about the astounding wealth of the leaders of the Saric narco cartel heighten the doubts among the general public that our privatization process provides a great opprotunity for 'laundering' of dirty money. And, all this allowed us to witness an «interesting» manner of communication utilized by state authorities, which reminds us of that childrens' game of «broken telephones».

First, the Administration for the Prevention of Money Laundering and Terrorism Financing stated that in Serbia, mainly through privatizations, over 1.700.000.000 euros is ‘laundered’ each year. That is a quarter of the state budget!!
