Sabic offers to resign as Commissioner

Commissioner for Information of Public Importance Rodoljub Sabic stated for Blic that he was prepared to hand his resignation as the Commissioner to the Serbian Assembly if the article which envisages that security agencies can for reasons of state and public safety  and as long as such reasons pertain deny access to relevant data, collection of data, and even access to premises to the body which should protect personal data, is not deleted from the Personal Data Protection Bill.

It is hard to understand that our country is the only one in Europe (apart from Montenegro) which does not have a law on secret data classification. But although we do not have a law on secrets, we have too many secrets. When instead of a modern law you have a confusing and contradictory conglomerate of several hundreds of anachronous regulations, it is not accidental but logical to give the confidential status to various information according to ambiguous, random and disputable criteria. And it is also logical that behind that confidentiality anything can be hidden, from stupidity and conservativism, through sluggishness and laziness to criminal actions and corruption.

Who has hidden the proposals of the Information Access and Secret Classification Acts?

Personal attitude  
Each year, according to the law, the Commissioner for Information of Public Importance submits Report to the National Assembly. Those reports, besides else, always contain recommendations for eliminating the envisaged shortcomings, including the proposals of the necessary changes of the Free Access to Information Act, as well as pointing out to the need for passing some laws that do not exist in our country, and which are of extraordinary importance for establishing normal relations in the information access sphere.

(In)Disputable principle

The last information speak that the attitude of the Government of Serbia not to accept any additional, special conditions that the Concessee sets for acceptance of termination of the Concession Contract for highway Horgoa Pozega by mutual consent. For majority of citizens, such an attitude is in line with the state dignity and is completely clear. However, many do not find it clear - why the talks about termination of the contract by mutual consent are held at all? Let's remind us, the contract was for a long time super secret. The ministry in charge hasn't made it public not even after the order of the Commissioner for Information, and the Government, although obliged, hasn't secured execution of that order.  Just significantly later, under the public pressure, basic contract has been publicized, and after that successively, the majority of Annexes.

The state ties our hands

If it wants to find itself at “White Schengen List", Serbia must pass laws about border protection, foreigners and personal data protection. The Minister of Police, Ivica Dacic, has announced passing of the first two laws in the next year, while the Proposal of the Personal Data Protection Act is already in the Assembly procedure. Its passing would enable exercising and protection of the privacy entitlement, as well as other rights and freedoms pertaining to personal data processing. Currently the Law from 1998 is in force, and according to the words of the Commissioner for Information of Public Importance, Rodoljub Sabic, not one case has been recorded of protection of the rights based on that law.

The global anti-corruption network “Transparency International” has published its Global Corruption Perception Index (CPI) for this year. In what is probably the most relevant anti-corruption list, our country has scored 3.4 on a scale of 1 to 10 (same as last year) and is tied for places 85-92 among the total of 180 ranked countries. This score, far below the passing 5.0, is indicative of a country in which corruption is a systemic problem and effectively out of control. Our ranking in the CPI list puts us among countries which are, unfortunately, “proverbially” very corrupt. It is then clear that we should not and cannot be satisfied either with the score or with our ranking - indeed quite the contrary.
