Proposal of the Law on Personal Data Protection contains some strange solutions

The National Assembly shall soon discuss the Proposal of the Law on Personal Data Protection. It is good that this is so, due to several reasons. As one would most usually say, adopting that law could bring us closer for a good step to  "White Schengen". Still more important is that this law could (and must) be a basic prerequisite for construction of one legal mechanism that we don't have, and which is necessary to one modern, democratic society.

Each year according to the law, the Commissioner for Information submits report to the National Assembly.  Those report have always, besides else contained recommendations for removing observed shortcomings, including the proposals of necessary changes of the Law on Free Access to Information. All three Reports submitted until now, together with proposals have been unanimously adopted in the Assembly Board in charge. Alongside that, the Commissioner warned the Government of Serbia about the need to change the law. The Government, law mover with „monopolistic“ position has never challenged that evaluation. However, three years have passed, and in the Assembly adequate law proposal did not appear for law change.

After the meeting he had yesterday with the Minister of Justice Ms Snezana Malovic, the Commissioner for Information of Public Importance Rodoljub Sabic still insists that restrictions on providing information to this institution for security reasons included in the Personal Data Protection Bill should be deleted.

Executive government has not enforced a single Commissioner's decision for three years. Security Information Agency and the Ministry of Infrastructure the least open for cooperation. Premises sufficient for seven officers.
