The Commissioner for Information of Public Importance and Personal Data Protection is finalizing the process of supervision over the implementation of the Law on Personal Data Protection (LPDP) in commercial banks operating in Serbia.

The Commissioner sent back in in March, immediately after completion of supervision, to the addresses of all banks a Warning that they perform, in various ways, unlawful processing of personal data by, without any basis in law, requiring and retaining photocopies of certain documents containing personal data (ID cards and passports of authorized persons, persons from specimen signature card and authorized to submit payment orders and withdrawal orders, owners having at least 25 percent of the shares in the capital, presidents and members of residents' associations, health cards of some persons, etc.).

The Commissioner for Information of Public Importance and Personal Data Protection received from the Security Information Agency a notification on compliance with the Commissioner's decision in connection with information on the use of special procedures and measures of secret collection of data from the sphere of competence of the Security Information Agency. The Security Information Agency enclosed evidence of compliance with the said decision to the notification.

The Commissioner for Information of Public Importance and Personal Data Protection issued to the Ministry of Trade, Tourism and Telecommunications the opinion on the Draft Bylaw on the Requirements for Devices and Programme Support for Lawful Interception of Electronic Communications and Technical Requirements for Compliance with the Duty to Keep Data on Electronic Communications.

The Commissioner's opinion is that the Bylaw (with its proposed content) should not be passed. Such Commissioner's opinion is based on the fact that the Draft Bylaw also provides for a number of issues which cannot be regulated by secondary legislation, as well as that it contains arrangements which are incompliant with and contrary to the Constitution, the Law on Electronic Communications and the Law on Personal Data Protection. According to the Commissioner, the adoption of such Bylaw would imply great, both potential and actual, risk of jeopardizing many citizens' rights to privacy, secrecy of communications and personal data protection.

Emphasizing that those issues which, according to the Constitution, can and must be regulated exclusively by the law, the Commissioner suggested to the Minister to open a broad public debate with the aim of amending the applicable or enactment of the new Law on Electronic Communications.

The Commissioner for Information of Public Importance and Personal Data Protection received from the Military Security Agency a notification on compliance with the Commissioner's decision in connection with information on the use of special procedures and measures of secret collection of data from the sphere of competence of the Military Security Agency. The Military Security Agency enclosed evidence of compliance with the said decision to the notification.
