The Commissioner for Information of Public Importance and Personal Data Protection received from the company "Perutnina Ptuj - Topiko" doo Backa Topola a letter informing him about the compliance with the received warning. The Commissioner warned the company against unlawful processing of personal data after the suspension procedure regarding the polygraph testing which was conducted on a group of employees.
In its letter "Perutnina Ptuj - Topiko" doo gives assurances that the processing of personal data was carried out with good intentions, unconscious of the unlawfulness, expresses regret about the polygraph testing and confirms it will fully comply with the Commissioner's warning.
The company emphasizes it will in the future abstain from any activity involving personal data processing via a polygraph, and all data obtained during the polygraph test on a group of employees will be destroyed by a commission, thus preventing its use for any purpose.
The Commissioner said that, despite the confusing initial reaction, the company at the end responded to the Commissioner's warning in a good, expected way. The Commissioner, however, underlines that this specific case is certainly not isolated and it would be good, important and useful to serve as an example and a warning to other employers.
In this regard, the Commissioner stresses that his activities should not and cannot replace the activities of other state authorities. The powers and competencies of the Commissioner allow him to react only in case of violation of the right to protection of personal data of employees, not to the violation of other rights. An unlawful processing of personal data very often may involve other, even very serious violation of the dignity and rights of employees, which underlies the importance of the need and obligation to react other competent state authorities.
